A vaccine injury is any injury that is the result of a vaccine. This could be Seizures, brain damage or death. If your child’s doctor can’t explain some injuries or symptoms that your child developed since receiving a vaccine, this could be a vaccine injury.

Claims that vaccines cause injuries have been more prevalent in the last 10 or 20 years and many have resulted in lawsuits. Juries in the past have awarded sizable compensation to some families, over the protestations of health officials who thought that the claims of vaccine injuries have no foundation. Nonetheless, this caused some makers of vaccines to stop making their products. Because of that, some laws have been put into affect to protect these manufacturers from liability.

Vaccine Injury Compensation Program

In 1988 a way to compensate individuals and their families who were injured in some way by a vaccine received as a child was instituted. The National Injury Compensation Program (VICP) came about as a result of a scare centered on the part of the DPT vaccine that covered pertussis. Since vaccine manufacturers had at this point already been protected from liability, the VICP adopted a no-fault type of dispute resolution method to resolve claims of vaccine injury.

Since 1988, a fee of 75 cents charged for each vaccination has funded the VICP. In order to win a claim and collect compensation, the claimant must only have minimal evidence. For instance, if a child’s medical records indicate that he or she presented with only one of the many listed negative side effects soon after receiving the vaccination, it is assumed that the vaccine caused the side effect. All that has to be shown is that it is more likely than not that the vaccine was the cause. VICP claims may be denied, but further action can be pursued through regular lawsuits.

From the start of the program until January of 2008, around 9000 claims have been presented through VICP, 925 of which received compensation, for a total of $847 million, including the fees of the claimant’s attorneys.
